Aged Dependent Relative Visa (SC 114 & SC 838)

These are permanent resident visas available for some older people who are solely dependent on an eligible relative in Australia to provide them with financial support.

Applicants must be single (do not have a spouse) and must have been dependent on the sponsoring relative (or their partner) for at least last 3 years.

Applicants can lodge a:

  • SubClass 114 – Aged Dependent Relative visa application while off-shore
  • Or a SubClass 838 – Aged Dependent Relative application while in Australia (onshore) on a visa that does not have a condition 8503 – No further Stay.

The number of such visas granted every year is very limited.
Processing time can hence take several years.

Applicant Requirements

  • Age – must be above Australian Pension Age
  • Status – Single (no spouse/de facto or dependents)
  • Sponsored by a relative (or their partner) who lives in Australia
  • Must have been financially dependent on Australian relative for last 3 years
  • Need someone to provide Assurance of Support (AoS)
  • Meet Health and character requirements

Definition – Sponsor

  • Sponsor is a relative on whom the applicant has been financially dependent for last 3 years.
  • Sponsor is over the age of 18 years and settled in Australia as an Australian citizen, Permanent resident or an eligible New Zealand citizen.

Definition - Assurance of Support (AoS)

  • Assurance of Support (AoS) can be provided by a person or organization or a combination of up to 3 people
  • Assurance of Support (AoS) bond as a legal commitment to provide the applicant with financial support, such that the applicant would not rely on Australian social security payments.
  • This AoS bond maybe refunded after two years of the applicant having entered Australia.
  • The AoS is requested towards the end of the processing of the Aged Dependent Relative visa application.

Definition – Eligibility Age for Pension in Australia

Women - Born before 1949 or if after 1949, then at the attainment of 65 years

The pension age for men and women born from 1 July 1952 will be gradually increased from 65 to 67 years as set out in the table below.

Aged Dependent Relative Visa Holder – Rights 

  • Both SC 114 and SC 838 are permanent resident visas allowing the holder to live in Australia indefinitely.
  • Holders can study, work, enroll in Medicare and apply for Australian citizenship.
  • The holder can travel to and from Australia for up to 5 years. After this period, they may have to apply for a resident-return visa to re-enter Australia (unless they have become an Australian citizen)
