Child Visa – SC 101 & SC 802
This is a permanent visa granted to a child:
- under the age of 18 years;
- who is sponsored by an Australian parent;
- and the parent is either:
- an Australian citizen,
- an Australian Permanent Resident, or
- an eligible New Zealand citizen living in Australia.
The child must be either:
- A biological child of an Australian parent
- An adopted child;
- or a step-child of the Australian parent before they became an Australian citizen, permanent resident or eligible New Zealand citizen
- A child conceived through artificial conception procedure to an Australian parent
- A child born under a surrogacy arrangement and parentage has been transferred to an Australian parent by court order under prescribed country or local law.
A child applying from off-shore applies for a SC 101 visa.
While a child already in Australia would apply for a SC 802 visa.
Other requirements – Child Visa
- Age – less than 18 years.
- If age 18+ years (and less than 25 years) - Child must be engaged in full-time study and dependent on the sponsoring parent.
- Age Exemptions – may apply to the maximum age of 25 years for disabled dependent children of sponsoring Australian parent.
- Written consent of each person who can legally decide where the child lives
- Meet the laws of the child’s home country permitting the removal of the child to Australia.
- The child applicant must meet the health (and character if over 16 years of age) requirements.
This visa may not be granted if it is against the best interests of a child younger than 18 years of age.
Sponsor
- Must be a parent of the child and over the age of 18 years.
- Must be an Australian citizen, Permanent resident or eligible New Zealand citizen residing in Australia
- Can be a step-parent who is no longer the partner of the child’s parent, but has legal responsibility to care for the child under the age of 18 years.
- Can also be an adoptive parent who adopted the child before they became an Australian citizen, permanent resident or eligible New Zealand citizen.
- Be responsible for caring the child adequately and provide accommodation, financial and other living needs for at least the first two years in Australia.
Children adopted after a sponsor became an Australian citizen, permanent resident or eligible New Zealand citizen must apply for an Adoption visa (SC 102)
Child Visa Holder - Rights
- SC 101 and SC 802 are permanent residence visas allowing the child to live in Australia indefinitely.
- Can study, work, enroll in Medicare and apply for Australian citizenship.
- Can travel to and from Australia for up to 5 years.
After this period, they may have to apply for another visa to re-enter Australia (unless they have become an Australian citizen)
