Temporary Visa – Dependent Child Visa

This is a temporary visa granted to a child whose parent holds a temporary or provisional partner visa.

This visa is generally applied by a child who was initially not included as a dependent in the partner visa applicant of their parent. 

In other words, when an overseas national becomes a partner of an Australian resident and later wants to bring their dependent child to Australia, they can apply for a SC 445, dependent child visa while they are still in Australia on a temporary partner visa.

The child in such case must be sponsored by the same person who sponsored their parent.

Basic Guidelines for Parent and Sponsor

  • This is a temporary visa for the child of a parent holding a temporary partner visa and who had not included the child in their initial partner visa application.
  • The child must be a natural, step or adopted child of the parent and must be sponsored by the same person sponsoring their parent. 
  • As soon as this visa is granted and the child enters Australia, they must also be included in the permanent partner visa application of their parent.
  • If the parent is granted a permanent partner visa without having included their child who is in Australia on a Dependent Child visa; then the child may become unlawful in Australia.
  • Alternately, parents already granted a permanent partner visa can apply for a Child visa (SC 101 or SC 802).

Visa Application requirements 

  • Child must be below 18 years of age (see exemptions below)
  • If child is above 18 years they must be financially dependent on the parent or incapacitated for work due to disability.
  • The child must be a natural, step or adopted child of the parent and must be sponsored by the same person sponsoring their parent.
  • The child applicant must meet the health (and character if over 16 years of age) requirements.

Sponsor

  • Must be over the age of 18 years and usually resident in Australia.
  • Must be an Australian citizen, Permanent resident or eligible New Zealand citizen residing in Australia
  • Must already be sponsoring the child’s parent for a permanent partner visa.
  • Be responsible for caring the child adequately and provide accommodation, financial and other living needs for at least the first two years in Australia.
  • Must assist the child settle in Australia and support the child to attend any English language classes if required

Dependent Child Visa Holder - Rights

  • SC 445 is a Temporary residence visas allowing the Adopted child to come and live in Australia while their parent holds a Temporary Partner Visa.
  • Can study, work, enroll in Medicare and apply for Australian citizenship.
  • Is generally valid till a decision on the child’s permanent partner visa is made.
