Remaining Relative Visa (SC 115 & SC 835)

These are permanent resident visas available for people whose only near relatives live in Australia.

Applicants can lodge a:

  • SubClass 115 – Remaining Relative visa application while off-shore
  • Or a SubClass 835 – Remaining Relative application while in Australia (onshore) on a visa that does not have a condition 8503 – No further Stay.

There are caps on the number of such visas granted every year.
Processing time can hence take several years.

Applicant Requirements

  • Applicant (and their partner’s) only near relatives live in Australia. 
  • Applicant and any family members will be sponsored by an eligible relative (or their partner)
  • Need someone to provide Assurance of Support (AoS)
  • Meet Health and character requirements

Definition – Near Relative

An applicant or their partner’s :

  • Parent – including biological and step-parent.
  • Brother, Sister, Step-brother, Step-sister
  • Child – including step-child, who has not yet turned 18 years of age.

Are considered as Near relative 

Definition – Sponsor

A sponsor, must be the applicant’s

  • Parent – including biological and step-parent.
  • Brother, Sister, Step-brother, Step-sister

Or one of their partners

Who is over 18 years of age and settled in Australia as

  • an Australian citizen,
  • an Australian Permanent resident
  • an eligible New Zealand Citizen

Applicant may not be eligible, if:

  • applicant or their partner have any near relative:
    • living in another country
    • living in Australia on a temporary visa, bridging visa or unlawfully
  • applicant or their partner have a sponsor
    • who themselves were the holder of a Remaining Relative visa
    • or sponsored someone else for a Remaining Relative visa

Remaining Relative Visa Holder – Rights 

  • Both SC 115 and SC 835 are permanent resident visas allowing the holder to live in Australia indefinitely.
  • Holders can study, work, enroll in Medicare and apply for Australian citizenship.
  • The holder can travel to and from Australia for up to 5 years. After this period, they may have to apply for a resident-return visa to re-enter Australia (unless they have become an Australian citizen)
